dated 1 January 1943 made between (1) Emily Bowyer Taylor (2) West

Sussex Property Trust Limited (Vendor) and (3) William John Perrins

(Purchaser) contains covenants details of which are set out in the

schedule of restrictive covenants hereto.

2 A Conveyance of the land edged blue on the title plan and other land

dated 21 June 1946 made between (1) Samuel Robert Single (Vendor) and

(2) William John Perrins (Purchaser) contains covenants details of

which are set out in the schedule of restrictive covenants hereto.

3 (09.12.1996) A Transfer dated 30 October 1996 made between (1) Frys

Properties Limited and (2) Blue Anchor (Boot Sales) Limited contains

provisions which relate to the payment of additional moneys as therein

Schedule of restrictive covenants

1 The following are details of the covenants contained in the Conveyance

dated 1 January 1943 referred to in the Charges Register:-

"FOR the benefit of the remainder of the Vendor's Estate at South

Godstone aforesaid and lying to the east of the piece or parcel of land

hereby conveyed and so as to bind the property hereby conveyed the

Purchaser hereby covenants with the Vendor as follows:-

(a) That when and so soon as the Purchaser shall obtain vacant

possession of the piece or parcel of land hereby conveyed he will

forthwith erect and thereafter maintain a good and sufficient stock

proof division fence along the eastern boundary of the piece or parcel

of land hereby conveyed.

(b) That so long as a similar covenant is observed by all and every

other the Purchasers from the Vendor of any part of the said estate

remaining unsold, no dwellinghouse shall be constructed on the piece or

parcel of land hereby conveyed otherwise than of brick, stone, cement

or other similar material with or without timbering and with tiled or

slated roof and prior to the erection of any dwellinghouse or bungalow

to submit the plans thereof to the Vendor's Surveyors for their

approval (which approval shall not be unreasonably withheld) and to

supply the Vendor's said Surveyors with one copy of such plans for

retention and pay such Surveyors the fee of One guinea for each

PROVIDED that the Purchaser or other the owners for the time being of

the piece or parcel of land hereby conveyed shall be liable only in

respect of breaches of this covenant which occur while he or they shall

respectively be owner or owners of the property in respect of which any

breach occurs."

2 The following are details of the covenants contained in the Conveyance

dated 21 June 1946 referred to in the Charges Register:-

"THE Purchaser for himself and his successors in title hereby covenants

with the Vendor as to the land hereby conveyed so as to run with the

land not to erect any dwellinghouse or other buildings on the said land

otherwise than of brick stone cement or other similar material with or

without timber and with tile or slate roof but so that the Purchaser

shall be liable only in respect of breaches of the said covenants which

occur whilst he is the owner or owners of the land in respect of which

any breach shall occur."
